Email Acceptable Use Policy

This policy defines what is and is not permitted on Exact Hosting's email services. It explains how bulk email and spam are defined, lists the activities that are prohibited, and describes how Exact Hosting responds to violations.

Important: Accounts that violate this policy may be shut down immediately, without warning or notice. Review the prohibited activities below before sending bulk or commercial mail through Exact Hosting.

About the Email Acceptable Use Policy

This policy applies to all email sent through Exact Hosting's email services, including Enhanced Email and cPanel email. It supplements, and does not replace, the Exact Hosting Terms of Service and Privacy Policy. The terms below also apply when an Exact Hosting account uses third-party tools to send mail through Exact Hosting's email systems.

What counts as "bulk email"?

"Bulk Email" is defined as Unsolicited Commercial Email (UCE) transmitted within a short time frame to users who were not given the option to unsubscribe from or opt out of receiving such email.

If you need to run a mailing list, Exact Hosting encourages the use of a third-party email service provider where recipients can voluntarily opt in and opt out.

What counts as "spam email"?

Under the U.S. CAN-SPAM Act, "spam email" is an electronic mail message whose primary purpose is the commercial advertisement or promotion of a commercial product or service, including a message that promotes content on a commercial website.

Exact Hosting further defines spam email as sending unwanted email messages — frequently with commercial content — in large quantities to users who were not given the option to unsubscribe or opt out.

What activities are forbidden on Exact Hosting email services?

The following actions are strictly forbidden when using Exact Hosting email services:

  • Using or including invalid or forged headers.
  • Sending email that uses or includes invalid or non-existent domain names.
  • Impersonating another individual or their email address (spoofing), or creating false accounts to send spam.
  • Conducting data mining or using bots ("robots") to harvest email addresses or other web data for unsolicited or unauthorised material.
  • Using Exact Hosting's email systems to facilitate the transmission of unsolicited or unauthorised materials.
  • Using a third party's internet domain name, or relaying from or through a third party's equipment, without their permission.
  • Sending email to users who have requested to be removed from a distribution list.
  • Transmitting the same message multiple times to a large number of recipients.
  • Selling, exchanging, or distributing the email addresses of any Exact Hosting email customers to a third party without their knowing and ongoing consent.
  • Interfering with any other party's use of their email services.

What additional restrictions apply?

In addition to the violations outlined in Exact Hosting's Terms of Service, the following activities are prohibited:

  • Sending email that violates the CAN-SPAM Act or any similar anti-spam law or regulation.
  • Altering identifiers such as email headers, IP addresses, and server names; impersonating another person or email address; or creating fake accounts to send spam.
  • Sending the same message multiple times, or sending it to an excessively large number of recipients.
  • Using bots ("robots") or other automated means to access anyone's email address for the purpose of sending unsolicited or unauthorised material.
  • Selling, exchanging, or distributing email addresses of any person to a third party without their knowledge, initial consent, and ongoing consent.
  • Engaging in any illegal, illicit, or damaging activity using Exact Hosting email products or services, including for marketing or promotional purposes.
  • Mining any web property, including search engines, to discover email addresses.
  • Sending unauthorised mail via open, third-party servers.
  • Sending email to more recipients than the maximum allowed number.
  • Sending email to users who have requested removal from a mailing list.
  • Sending unsolicited email to a significant number of email addresses belonging to individuals or entities with whom you have no pre-existing relationship.

What happens if an account violates this policy?

Any account that engages in the prohibited activities listed above may be shut down immediately, without warning or notice.

If your account was suspended for SMTP relay abuse, for example, the error 554 5.7.1 End-of-data rejected: user smtprelay service AUP suspended, reset the mailbox password immediately and then contact Exact Hosting Support. How should I send legitimate marketing or bulk mail?

Use a reputable third-party email service provider that supports verified opt-in lists, one-click unsubscribe links, and bounce handling. Exact Hosting's mail servers are sized for ordinary business correspondence and are not intended for marketing campaigns.
